DMCA & Copyright Policy

Elevio Solutions ("we," "us," "our"), operating as Polyglot Translate Cloud ("Polyglot Cloud"), respects the intellectual property rights of others. This policy describes how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable international copyright laws including the EU Copyright Directive (2019/790).
1. How Copyright Applies to Translation
Translation involves the creation of derivative works from source material. Our Platform processes text submitted by users and stores translations in a community Translation Memory. Copyright considerations include:
- Source text: Users are responsible for having the right to submit source text for translation. We do not verify whether users have copyright permission for the content they submit.
- Translations: Machine translations generated by AI models may not be independently copyrightable in all jurisdictions. However, human-edited or human-created translations (e.g., contributor submissions) may have copyright protection.
- Translation Memory: TM entries consist of source-target text pairs. If copyrighted source text is stored in the TM, the copyright holder may request removal.
2. Reporting Copyright Infringement (Takedown Request)
If you believe that content on our Platform infringes your copyright, please send a written notice to our designated agent with the following information:
- Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material — a description of where the allegedly infringing material is located on our Platform. Provide enough detail for us to identify it (e.g., specific translation text, source-target pair, language pair, or URL).
- Your contact information — your name, address, telephone number, and email address.
- A statement of good faith — a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury — a statement that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your signature — a physical or electronic signature of the copyright owner or an authorized representative.

3. Our Response to Takedown Requests
Upon receiving a valid DMCA notice, we will:
- Acknowledge receipt within 2 business days.
- Investigate the claim and identify the allegedly infringing material.
- Remove or disable access to the infringing material within 10 business days if the claim is valid.
- Notify the user who submitted the content (if identifiable) of the takedown and provide them with a copy of the notice.
- Document the action and retain records of the notice and response.
For Translation Memory entries, removal means deleting the specific source-target pair(s) from the TM database. This may affect translation availability for other users of the same text, but we will comply with valid copyright claims.
4. Counter-Notification
If you believe your content was removed in error or due to misidentification, you may submit a counter-notification to our designated agent containing:
- Your name, address, telephone number, and email address.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
- A statement consenting to the jurisdiction of the courts of Belgrade, Serbia (or your local jurisdiction if required by law).
- Your physical or electronic signature.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed material.
5. Repeat Infringers
We will terminate the accounts of users who are repeat copyright infringers. Specifically:
- A first DMCA notice results in a warning and content removal.
- A second DMCA notice (within 12 months) results in a final warning and content removal.
- A third DMCA notice (within 12 months) results in permanent account termination.
We reserve the right to terminate accounts on the first offense for egregious or willful infringement.
6. EU Copyright Directive (DSA Compliance)
For users and claimants in the European Union, we also comply with the EU Digital Services Act (DSA) and the EU Copyright Directive (2019/790). In particular:
- We provide a clear mechanism for reporting unlawful content (this page).
- We act expeditiously upon obtaining knowledge of infringing content.
- We provide the affected user with a statement of reasons for removal.
- We maintain a transparent process for counter-notifications and appeals.
EU-based claimants may send notices to the same designated agent listed above.
7. Misuse of DMCA Notices
Filing a false DMCA takedown notice is illegal under 17 U.S.C. § 512(f). If you knowingly misrepresent that material is infringing, you may be liable for damages, including costs and attorney's fees. Please ensure you have a good faith belief before submitting a notice.
8. Limitation
This policy applies to content hosted on our Platform (polyglot-translate.cloud) and stored in our Translation Memory. It does NOT apply to:
- Content stored in users' own WordPress databases via the Polyglot Translate plugin (contact the website owner directly)
- Translations cached in users' browsers via localStorage
- Content on third-party platforms that may use our API
